User Agreement
Article 1 - Definitions In these general terms and conditions, the following shall be understood:

1. Entrepreneur: a legal entity registered as BRILLIAN@T that provides goods and/or services to the consumer at a distance;
2. Consumer: an individual who does not act for professional purposes and enters into a contract at a distance with the entrepreneur;
3. Distance contract: a contract concluded between the entrepreneur and the consumer within the framework of a system for distance selling of goods and/or services, where only one or more means of distance communication are used before the conclusion of the contract and within this system;
4. Distance communication technologies: means that can be used to conclude a contract without the need for the personal presence of the parties - in this case, www.brillianat.net;
5. Cancellation period: the period during which the consumer or the entrepreneur may exercise their right to cancel the distance contract;
6. Right of withdrawal: the consumer's or entrepreneur's ability to cancel the distance contract during the cancellation period;
7. Day: calendar day;
8. Transaction: a distance contract for the purchase of goods and/or services.

Article 3 - Application

1. These general terms and conditions apply to each offer made by the entrepreneur and to each distance contract concluded between the entrepreneur and the consumer.
2. These general terms and conditions are published and available on the website www.brillianat.net. It is presumed that the consumer has acquainted themselves with these terms before placing an order in the online store.

Article 4 - Offer

1. If an offer has a limited period of validity or is subject to change, this will be explicitly stated in the offer.
2. All offers contain detailed information about the product or service so that the consumer can make an informed choice.
3. BRILLIAN@T guarantees that all images of products on the pages of the online store are accurate representations of the offered goods and/or services. The entrepreneur is not liable for obvious errors or inaccuracies in the images.

Article 5 - Contract

1. The contract comes into effect when the consumer accepts the offer and fulfills the corresponding conditions for placing an order on the website of the online store www.brillianat.net.
2. If the consumer accepts the offer electronically, the entrepreneur immediately confirms receipt of the electronic acceptance of the offer by sending confirmation of the order acceptance by email to the address provided in the order form. Until the entrepreneur has confirmed receipt of such acceptance, the consumer may terminate the contract.
3. If the contract is concluded electronically, the entrepreneur takes security measures for the electronic transfer of data and ensures a secure e-commerce environment. In this case, if the consumer can pay electronically, the entrepreneur will take appropriate technical and organizational security measures.
4. The entrepreneur may verify whether the consumer has saved the identification data and the terms of the contract. If necessary, they will take appropriate technical and organizational security measures.

Article 6 - Right of Withdrawal

1. With regard to the purchase of goods, the consumer has the right to cancel the contract without giving reasons within the withdrawal period.
2. The withdrawal period begins on the day after the consumer or a representative designated by them and the entrepreneur in advance receives the goods, in this case, within two weeks of receiving the goods.
3. With regard to the purchase of services, the consumer has the right to cancel the contract without giving reasons within the withdrawal period, which begins on the day of conclusion of the contract.

Article 7 - Consumer's Obligations in Case of Cancellation and Expenses

1. If the consumer exercises their right of withdrawal, they must notify the entrepreneur within the withdrawal period and return the goods within this period.
2. The consumer returns the goods in their original packaging, exclusively in the absence of signs of use, and in accordance with the entrepreneur's instructions set out on the website of the online store.
3. The risk and burden of proof of the correct and timely exercise of the right of withdrawal lies with the consumer.
4. The consumer bears the cost of returning the goods.

Article 8 - Payment

1. If the consumer cancels the contract, they only have to pay the expenses specified in Article 7.
2. The entrepreneur shall reimburse payments to the consumer promptly within the periods indicated on the website www.brillianat.net, but no later than 14 days from the date of cancellation.

Article 9 - Exception to the right of withdrawal

1. The right of withdrawal shall not apply to contracts for the supply of goods, the performance of which begins with the consumer's consent within the withdrawal period, if the consumer subsequently withdraws their consent.
2. The right of withdrawal shall not apply in the case of a breach of the integrity of the Product Personalization Tag.

Article 10 - Price

1. Within the period specified in the offer, the prices of products and/or services shall not be increased, except for changes in VAT rates.
2. Notwithstanding the foregoing, the Entrepreneur may offer products or services with variable prices, linked to fluctuations in financial markets and over which the Entrepreneur has no influence, with variable prices. These fluctuations and the fact that any prices mentioned may be stated prices will be stated in the offer.
3. Prices of products or services will not be increased during the validity period of the offer, but the Entrepreneur reserves the right to change prices in the event of changes in VAT rates.

Article 11 - Compliance and Guarantees

1. The Entrepreneur guarantees that the products and/or services comply with the contract, the specifications stated in the offer, the reasonable requirements of reliability and/or usability and the existing legal provisions and/or government regulations at the date of the conclusion of the contract.
2. The guarantee provided by the Entrepreneur does not affect the consumer's rights and claims under the law and/or the contract.
3. If the product is not properly executed, the consumer must notify the Entrepreneur of this within 14 days after discovering the defect.

Article 12 - Delivery and Implementation

1. The Entrepreneur shall exercise the utmost care when receiving and implementing orders for products and when assessing requests for the provision of services.
2. The place of delivery shall be the address that the consumer has provided to the Entrepreneur.

Article 13 - Duration, Termination and Extension of Contracts

1. The consumer may terminate an agreement that has been entered into for an indefinite period and which extends to the regular delivery of products (including electricity) or services, at any time, in accordance with the agreed termination rules and a notice period of not more than one month.
2. The consumer may terminate an agreement that has been entered into for a definite period and which extends to the regular delivery of products (including electricity) or services, at any time, by the end of the fixed period, in accordance with the agreed termination rules and a notice period of not more than one month.
3. An agreement that has been entered into for a definite period and which extends to the regular delivery of products (including electricity) or services may not be tacitly renewed or renewed for a definite period.
4. If an agreement has a duration of more than one year, the consumer may terminate the agreement at any time after one year, with a notice period of not more than one month, unless reasonableness and fairness oppose termination before the end of the agreed term.

Article 14 - Payment

1. Unless otherwise stipulated in the contract or additional terms and conditions, the amounts owed by the consumer must be paid within 14 days after the start of the withdrawal period, or in the absence of a withdrawal period, within 14 days after the conclusion of the agreement.
2. When selling products to consumers, the general terms and conditions may never require an advance payment of more than 50%. When an advance payment has been stipulated, the consumer cannot assert any rights regarding the execution of the order or service(s) in question before the stipulated advance payment has been made.
3. The consumer has the duty to report inaccuracies in provided or stated payment details to the Entrepreneur without delay.

Article 15 - Disputes

1. Contracts between the Entrepreneur and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law.
2. Disputes arising from a contract between the Entrepreneur and the consumer, which cannot be resolved by mutual agreement, shall be submitted to the competent Dutch court.

Article 16 - Additional or different provisions

1. Additional or different provisions from these general terms and conditions may not be to the detriment of the consumer and must be recorded in writing or in such a way that they can be stored by the consumer in an accessible manner on a durable medium.

CONSENT
