DELIVERY & WARRANTY

General Terms

1. General Terms and Conditions of Delivery and Warranty (GTC) of BRILLIAN@T - constitute an integral part of all offers, declarations of will made when performing legal actions, all agreements concluded by BRILLIAN@T, including rents, sales, deliveries and aftersale services.

2. Regulations different to the provisions of the GTCs shall be null and void unless agreed in writing by BRILLIAN@T and the Buyer, hereinafter referred to as the "Parties". "Consumer" means a party to the sales contract, as well as the offer addressee, ordering party, principal, authorized seller and other persons being a party to legal relations with BRILLIAN@T.

3. The GTCs are deemed to be delivered to the Consumer at a moment of placing an order. GTCs complements in particular with the trade offer or invoice if needed (upon the buyer's request). The content becomes the binding legal regulation between the Parties. By placing an order, the Consumer agrees to all the specifications of these Terms regarding an item described on the Personal Page, also including the delivery method with all details.

4. The GTCs are accepted by the Consumer also in any other way if the Consumer's behavior shows that he has read them. In the absence of any other written agreements or arrangements, the content of the GTCs is the only binding legal regulation between the Parties.

Scope of delivery & packaging.

1. The Consumer is responsible for the veracity and correctness of the data provided in the order, including the Packaging and Delivery method attached to the order. The Consumer may not refuse to accept the goods delivered in accordance with his own order.

2. BRILLIAN@T guarantee that the Consumer will receive the exact item shown on the web-shop including Certificates and appearance, excluding any postal mishaps.

3. BRILLIAN@T reserves copyrights to items as designed and produced by BRILLIAN@T. Designs, drawings and other similar documents presented individually to the Consumer, which are confidential, may not be made available by the Consumer to third parties in part or in whole without the written consent of BRILLIAN@T . Violation of this provision entitles BRILLIAN@T to take legal action with claims for breach of trade secrets under the provisions of EU law and regulations.

Delivery time & Cancelation

1. The delivery time is considered to be pre-agreed. It understood as BRILLIAN@T's commitment to deliver the goods to the Consumer, to the location specified in the order, within the designated timeframe of days, weeks or months. Essentially, this means:

BENELUX delivery - within one full week, depending on the country of delivery,

EUROPE delivery outside BENELUX - within full two weeks, depending on the country of delivery,

Outside EUROPE delivery - within one month, depending on the country of delivery.

2. Taking into account the point 1 of Delivery time & Cancellation, Post Delivery method still leaves some uncertainty in the question of delivery time (it may be dependend on the postal service itself in the country of delivery) and cannot be complained about. BRILLIAN@T does not disclame the responsibility for a delivery delay in any case the ordered item was sent via Post service within the required amount of days.

3. The delivery period begins on the day of sending the Consumer an order confirmation, but not earlier than on the day the Consumer provides all the required information and after receiving the full payment on BRILLIAN@T's bank account only.

4. The delivery period may not start for some force majeure reason. In this case BRILLIAN@T reserves the unlimited right to cancel the order. In this case the Consumer will be informed on shortest notice possible.

Warranty

1. Any pearl containing item will contain real pearls only.

2. All jewellery comes with either a Certificate of Authenticity, Private Jewellery Certificate with Gemological report or Private Gemological Certificate from our Certification Center.

3. Each item is uniquely named following astronomical objects to guarantee exclusiveness and is provided with an attached Personal Tag with a corresponding Personal QR-code.

4. All items come with an International Warranty (IW) for a period of years as indicated on the item's Warranty Card starting from the date of purchase.

5. The warranty covers cleaning and repairs; however, loss of any pearls is excluded. Misuse of jewellery results in a void of Warranty. In case of a dispute regarding misuse  BRILLIAN@T reserves the right to demand proof regarding usage to be  provided by the Costumer.

6. For our top-range items, IW also covers adjustments to the specific jewellery upon request agreed in advance. Additional materials including pearls will be charged.

Sending costs & Refunds

1. The initial sending costs for all services provided during the warranty period are covered by BRILLIAN@T. Subsequent sending costs will be charged.

2. Item without any traces of use can be returned within 2 weeks from the date of delivery, provided the Personal Tag is not damaged. Refunds will be processed within one working week after the item is received by BRILLIAN@T. Items made to Costumer specifications are excluded from this Return Policy.
